A Nullification That Failed

From the mid-1950s to the mid-1960s, the Southern States failed in their attempt to nullify federal acts that forced desegregation and integration, following the recommendations of Madison, which the Tenth Amendment Center (TAC) endorses. Not only did the Southern States dislike these acts,  but most of them were unconstitutional. 

In Brown v. Board of Education (1954), the US Supreme Court based its desegregation ruling primarily on personal biases, sociology, and politics, with the US Constitution playing only an insignificant role. When Congress proposed the Fourteenth Amendment, it did not intend for it to apply to schools. Shortly after its ratification, Congress established a racially segregated school system for the District of Columbia.

According to TAC, Madison identified four appropriate methods that a State and “we the people” of that State could use to oppose and nullify an unconstitutional federal act or even a disliked federal act. A discussion of these four follows.

1. Popular protest by the people. “We the people” of a State may vigorously and vociferously protest against an unconstitutional or even disliked federal act. Southerners protested resolutely and vehemently against forced federal integration acts, but the federal government successfully suppressed their protest. Their protest did nothing more than bring more federal oppression and less liberty.

2. Refuse to cooperate with the federal government. Wholeheartedly, the Southern States not only refused to cooperate with the federal government, but they also interfered with its enforcement of federal integration acts. With great fervor, they opposed federal integration acts. Their disobedience and lack of cooperation did nothing except invigorate the federal government’s resolve to become more tyrannical and oppressive.

3. Formal protest by the governor. Few governors have ever protested unconstitutional acts of the federal government as did Governor Faubus of Arkansas and Governor Wallace of Alabama. All their protest did was cause the federal government to use military force against Arkansas and Alabama to quell their protest. Other governors protested, but to no avail. Their protest led to more subjection and despotism.

4. Legislative action. Legislative action includes resolutions formally protesting the federal government’s usurpation and unconstitutional acts. Legislatures may forbid agents of the State and its local governments from cooperating with the federal government in enforcing the federal act. It may even include interfering to prevent the federal government from enforcing an unconstitutional federal act. However, legislative action does not extend to preventing federal agents from enforcing unconstitutional federal acts with imprisonment or fines. State legislatures of the Southern States took actions to thwart the enforcement of federal integration acts, short of jailing federal agents. Again, the results were the same: more oppression, tyranny, and loss of liberty.

Madison believed that if adjoining States protested against a federal act and sought to nullify it with the aforementioned actions, their actions would cause the federal act to become void. Madison was wrong. The Southern States were unified in their protest of the federal government’s integration acts. Yet, their unity did nothing to stop the federal government’s tyranny.

The Southern States did not resort to jailing federal agents attempting to enforce school integration. However, this action would have also failed because the philosophy of "might makes right" dominated the country. (With the possible exceptions of the Cleveland, Harding, and Coolidge administrations, this philosophy has been the dominant governing principle of the federal government since 1861 — even superseding the Constitution.) Since the federal government used military force against Arkansas and Alabama in response to much milder forms of nullification, it would have used even greater force against a State that jailed its agents. (If a State had nullified these federal acts following Calhoun’s philosophy instead of Madison’s, these acts would not have applied in the nullifying States. Consequently, the federal government could not have lawfully used the military to enforce them because they did not exist in the nullifying States. However, since the federal government ceased following the Constitution in 1861, it would have used troops anyway.)

As a result of the Southern States’ failure to nullify the federal government’s integration acts, America’s education has deteriorated significantly. Worse, their defeat gave birth to racial quotas, political correctness, diversity-equity-inclusion, wokeism, and ultimately the death of the White race, Christianity, and Western Civilization. Such has been the goal of the Puritan Yankees since the mid-nineteenth century. Only the South stood in the way of this goal; that is why Lincoln and the Republicans had to destroy the South.

Madison may have wept over the utter defeat of the Southern States’ failure to nullify these unconstitutional federal acts. However, based on inferences from its writings, TAC has not.

However, the Southern States’ attempted nullification did lead to two of the three wars that the United States have won since World War II: Eisenhower’s war against Arkansas, Kennedy’s war against Alabama, and Reagan’s war against Grenada. Defeating these three world superpowers is the height of US military prowess in the post-World War II era.

Since Lincoln’s War, States have been highly successful at nullifying federal acts against vice, e.g., prohibition, which the Constitution authorized the federal government to prohibit the manufacturing, sale, and transportation of intoxicating liquors, and marijuana, which the federal government has no constitutional authority to outlaw or regulate. However, the nullification of most unconstitutional federal acts has been highly unsuccessful. The only nullifying acts that States are allowed are unenforceable protests and resolutions, and not participating with the federal government in enforcing federal laws (even this one seems to be fading under Trump).

In his speech, “Where Do We Go from Here?” (1967), I Have a Dream: Writings and Speeches that Changed the World (James Washington, ed., Harper Collins Publishers, 1986, 1982), Martin Luther King, Jr., presents what the Negro desiderates. A discussion of some of King’s demands follows.

Most conservatives claim that King is an archconservative. Many believe that he is the greatest conservative ever. Some have even deified him. Therefore, these conservatives should not only agree with all the demands of the greatest conservative ever, but they should also ardently promote them.

Like all integrationists, King blames the poor academic performance of Negroes on segregated schools. He notes, “In elementary schools, Negroes lag one to three years behind whites, and their segregated schools receive substantially less money per student than the white schools.”(p. 170.) Although schools have been integrated for half a century and standards have been lowered to accommodate Negroes, they still lag behind Whites by one to three years academically in elementary and even further behind in high school. Whatever the cause of Negroes lagging behind Whites, it has nothing to do with segregation. Does it ever occur to King, conservatives, and other integrationists that the reason that Negroes lag behind Whites is genetics and not segregation?

(In “The Rising Tide of Racial Consciousness” [1960] of the same book, King describes the high academic achievements that Negroes had accomplished during the Jim Crow Era [p. 64-65], which contradicts much of the agreement of the integrationists. Segregated schools had not held Negroes back academically.)

King declares that Negroes “must no longer be ashamed of being black.” (p. 170.) At least the Negro has overcome this problem. The self-esteem of the typical Negro far exceeds that of the typical White.

Moreover, King complains that the infant mortality rate of Blacks is significantly higher than White infant mortality rate (p. 170). Today, the leading cause of death of Negro infants is abortion. Although in this speech, King does not mention abortion; most likely, today, he would support abortion without restrictions because that is the progressive thing to do.

King was ahead of his time in changing and corrupting language. He favored eliminating negative connotations with “black” and positive connotations with “white” (pp. 170-171). Thus, King was woke decades before wokeism became the guiding principle of the country.

Continuing in his speech, King complains that the Negro contribution to American life has been ignored (p. 171). Black history month solved this problem. For a whole month, America is saturated with minor contributions of Negroes that make the work of Washington, Jefferson, and the other founding fathers pale into insignificance.

Next, King says, “‘Yes, I [the Negro] was a slave through my foreparents and I am not ashamed of that. I’m ashamed of the people who were so sinful to make me a slave.’” Contrary to what King may believe, the Bible does not condemn slavery or consider it a sin. Jesus never commanded that slaves be emancipated. Neither did Paul nor Peter. On the contrary, both Paul and Peter instructed slaves to be faithful to their masters.

Further, King complains about the lack of power that Negroes have (pp. 171-172). Negroes have overcome their lack of power. Today, they can bring down almost any White public figure by accusing him of being a racist, which now has at least 800 definitions, even without proof. Moreover, they have trained Whites to hate themselves so much that they will attack Whites who tell the truth about Negroes and smear them as “racists.”

Continuing, King says, “The problem of transforming the ghetto, therefore, is a problem of power.” (p. 172) Negro ghettoes are located in large cities, many of which Negroes govern. Moreover, these cities receive large influxes of federal grant money. For the most part, Negro ghettoes in these Negro governed cities are worse today than they were under Jim Crow when Negroes presumably had no power. Furthermore, the rest of these cities have deteriorated — this deterioration is directly proportional to the power of the Negro, just as it was in the South during Reconstruction.

Whatever the cause of the plight of the Negro during the Jim Crow Era, it had nothing to do with his lack of power. Where the Negro has had power, the condition of the Negro has not noticeably improved — except for those who govern and their cronies.

Then, King says “We must develop a program that will drive the nation to a guaranteed annual income.” (p. 173.) Consequently, since King is the greatest conservative ever, a guaranteed annual income is conservatism and not progressivism. All these King-worshiping conservatives are blaspheming their lord if they do not support and promote a guaranteed annual income. When are these conservatives going to institute and implement their lord’s demand for a guaranteed annual income?

Continuing with his speech, King argues for a war on poverty, which President Johnson gave him and every president has since continued (p. 174). (Since archconservative King advocated a war on poverty, then all good conservatives must fervently support the federal government’s war on poverty, the Constitution notwithstanding.) The country has been at war with poverty for 60 years and has little to show for it other than the squandering of trillions of dollars.

(In “The Rising Tide of Racial Consciousness” [1960] of the same book, King describes how Negroes were making enormous advances economically during the Jim Crow Era [p. 65]. And, they were doing so by their own efforts and merit, unlike today where their advancement depends mostly on handouts and governmental coercion such as affirmative action, quotas, set-asides, etc.)

Nevertheless, if all the noncash welfare benefits are considered, many of those identified as paupers live better than many taxpaying wage earners. Only a few homeless people are truly paupers. So, in this sense, the war has been won.

When King gave this speech in 1967, he said that riots were futile because “the local police, the state troopers, the National Guard and, finally, the army to call on—all of which are predominantly white.” (p. 175.) Today, many local police forces are predominately nonwhite — and the State police, National Guard, and the army are becoming ever more nonwhite. Most of the time, even Whites side with the Negro rioters. Consequently, riots can be and have been more effective in the twenty-first century than in the 1960s at cowardizing Whites into surrendering to Negro demands. 

One of the main reasons that King opposed a violent revolt by Negroes was that he believed that the Negro could not win such a revolt (p. 175). He was probably right. However, through propaganda, guile, threats, protests, and occasionally riots, the Negro could and finally did defeat the White man. Thus, following King’s advice, the Negro has not only defeated the White man; with the aid of self-hating Whites, the Negro is also well on his way to annihilating the White race.

Although King expressed a great desire for love and disdain for hate in his speech (pp. 175-176), his movement has led to a great deal of hatred toward Whites. This hatred is concealed in crime statistics of violent Negroes crimes perpetrated against Whites (see “The Dirty War: America’s Race War” by Thomas Allen). Worse, King’s movement has led to the hatred of White realists and White separatists by White albusphobes and Whites racial nihilists.

Like all good conservatives, King blames capitalism for poverty (p. 176). He favors an economic system between communism and capitalism — a blend of the two, which is what the country has today. Although he does not use the terms, what King is advocating is democratic welfare-state fascism, which is called democratic socialism in Europe. All good King-worshiping conservatives should support King’s economic philosophy.

Moreover, King opposed foreign investments because they exploited poor countries and led to the use of military force to protect foreign investments (p. 177). So far, King’s followers have failed to eliminate foreign investments and the concomitant wars. (Neoconservatives and establishment conservatives, who are the most ardent worshipers of King, are the most warmongering conservatives. Why have they ignored their god on this point?)

Also, in “Facing the Challenge of a New Age” (1957) of the same book, King writes:

There is nothing in all the world greater than freedom. It is worth dying for; it is worth losing a job; it is worth going to jail for. I would rather be a free pauper than a rich slave. I would rather die in abject poverty with my convictions than live in inordinate riches with the lack of self-respect. Once more every Negro must be able to cry out with his forefathers: “Before I'll be a slave, I'll be buried in my grave and go home to my Father and be saved.” (p. 27.)

Many of King’s followers have ignored his teachings about freedom. Many Negroes have enslaved themselves to the government via the welfare state. They prefer loafing in comfort with cradle-to-grave care to living free as a pauper.

Negroes have not gotten everything that King claimed that they wanted, such as a guaranteed annual income, although the welfare state comes close to it. In some respects, they have gotten more than they thought possible, such as getting Whites to genocide themselves. (Nevertheless, White supremacy will continue to exist long after the White race becomes extinct because White supremacy is so powerful that it will continue to dominate the world forever. Besides, Negroes cannot let White supremacy die because then they will have to accept responsibility for their failures instead of blaming Whites for their failures.)

    People often ask, “Why can’t we all just get along with each other?  Why can’t people just join hands and sing ‘Kumbaya’? Why is there such a great divide in the country — a divide that has not been seen since the War for Southern Independence?”
    The answer is simple. There are three groups of people: (1) the go-with-the-flow or go-along-to-get-along group, (2) the want-to-be-left-alone group, and (3) the determined-not-to-leave-them-alone group. As long as both of the last two groups exist, peace and harmony cannot exist. One or the other has to cease to exist before peace and harmony can exist.
    The go-with-the-flow group is by far the largest and is irrelevant. People in this group have taken the blue pill and remain in the Matrix. These people will march off to the concentration camps with hardly a grumble. They are the sheeple. No more needs to be said about this group.
    People in the want-to-be-left-alone group just want to live their lives and enjoy the fruits of their labor and their family and friends. People in the determined-not-to-leave-them-alone group are determined not to leave them alone or let them enjoy the fruits of their labor.
    Here is a short list, in no particular order, of what wearies people who just want to be left alone:
    –    They are tired of policies and programs being imposed on them that deliberately destroy their country (geographical territory) and nation (a people of common ancestry, origin, and heritage who have a common language, religion, and culture).
    –    They are tired of others telling them with the force of law how to use their property instead of allowing them to use their property as they see fit as long as they do not trespass against another.
    –    They are tired of the meddlers trying to disarm them so that they cannot resist the programs of the meddlers.
    –    They are tired of being forcibly medicated (water fluoridation, forced vaccination, etc.).
    –    They are tired of being denied medical treatment that the government does not approve even when these treatments have been shown to be superior to those approved by the government.
    –    They are tired of bureaucrats, who risk nothing, dictating to them how to operate their businesses, farms, etc.
    –    They are tired of being labeled “terrorists” because they love liberty.
    –    They are tired of being treated like criminals in order to fly and having their children molested so that they can board an airplane.
    –    They are tired of having the fruits of their labor taken from them via excessive taxation — especially when the revenue is used to control their lives, to impose on them agendas and dogmas to which they object, and to destroy what they value.
    –    They are tired of being forced to support programs with which they vehemently disagree — most of which they find inimical and detrimental to their welfare.
    –    They are tired of incompetent government agencies being rewarded for incompetence by increasing their budget when they fail to do their job, or, perhaps worse, agencies deliberately failing to do their job being rewarded with budget increases.
    –    They are tired of governments and big businesses spying on them.
    –    They are tired of their country and its people and resources being sacrificed for the benefit of other countries and multinational corporations.
    –    They are tired of governmental programs, policies, and agendas designed to reduce their standard of living — these programs and policies have been highly effective at doing this.
    –    They are tired of illegal aliens having more rights and privileges than they themselves have.
    –    They are tired of being forced to pay for a school system that propagandizes and indoctrinates the ruling elite’s dogmas and agendas instead of educating and teaching critical thinking.
    –    They are tired of judges, governmental agencies (usually child protection agencies), and the medical industry taking children from their homes because they disagree with the religion, politics, or medical decisions of the parents or because they merely disagree with the parents.
    –    They are tired of their language being corrupted in the name of political correctness.
    –    They are tired of being forced to take so-called tolerance-diversity courses where they are indoctrinated with the dogmas that people like them cannot be tolerated.
    –    They are tired of being indoctrinated with programs to effeminize men and destroy women with feminist dogma.
    –    They are tired of governments enforcing programs and policies against common sense and decency.
    –    They are tired of having a code of morality (immorality) forced upon them with which they not only disagree, but also find extremely noxious and destructive (a code of morality covers much more than sexual relations; it includes things like theft, murder, fraud, and lying).
    –    They are tired of being forced to participate in the delusions of mentally ill people.
    –    They are tired of being obligated for debts, especially without their consent, that because of their size can never be repaid and that will eventually destroy their country.
    –    They are tired of being laden with ever-increasing regulations and laws designed to control them.
    –    They are tired of governments and politicians lying to them.
    –    They are tired of governments siding with multinational corporations to oppress them.
    –    They are tired of governments serving shysters and special interests instead of the people in general.
    –    They are tired of the US Constitution being replaced with tyranny.
    In short, people who want to be left alone have become extremely weary of Washington bureaucrats and politicians and their owners and their toadies and lackeys in State and local governments imposing their agendas on them. They object to others, i.e., the people who are determined not to leave them alone, claiming that they (the others) know how the want-to-be-left-alone people ought to live their lives and then imposing that lifestyle on them.
    The do-not-want-to-leave-them-alone people have been coercing every item in the above list and much more. Moreover, they are determined to continue to impose these and more.
    To use the Matrix as a metaphor, people who want to be left alone are like Neo and Morpheus. People who are determined not to leave them alone are like Agent Smith; like him, they are driven to cleanse the world of the likes of Neo and Morpheus.
    Many people support Donald Trump because they see him as speaking for and defending people who just want to be left alone. They also see Hillary Clinton and Bernie Sanders as not wanting to leave them alone. They see these two only continuing and expanding control of their lives. Most supporters of Clinton and Sanders have the same view of Trump, Clinton, and Sanders.
    As long as these two antagonistic groups, i.e., people who want to be left alone and people who are determined not to leave them alone, exist, peace and harmony cannot exist. One of these two groups has to perish to achieve peace and harmony.

    The powers of Yankeedom and their quisling Southern sycophants are implementing their hideous program to destroy all that is Southern and all that is White at an accelerated pace. The assault is occurring on so many fronts and in so many places and with such ferocity that space does not allow for a detailed description. Only a short catalog of assaults is provided here.

    Through a combination of bribes and extortion, the imperialists in Washington have corrupted and captured the State and local governments in the South. First, they bribe the States with “free” money into adopting various grandiose programs that either have popular appeal or are good pork barrel. After State governments become addicted to this “free” money, the despots in Washington extort the States into adopting a multitude of welfare-state programs and other fascistic programs. The addicts cannot let go of the “free” money, so they endure tyranny. Thus, State governments in the South can no longer do anything of importance without the approval of the United States government. The Southern States have become mere colonies of the United States.

    If such tyranny were not enough to convince the Southern States that they have been reduced to colonies of the United States, there is the infamous Voting Rights Act. The Voting Rights Act denies the Southern States the right to draw their Congressional and legislative districts the way that each deems best for itself.

    A corollary to this odious law is that before a Southern town may annex an area, it must have the blessing of the United States government. This is done in the name of protecting black power (and privileges) and to remind Southerners that they are not a free people.

    At the behest of their Northern overlords, latter-day scalawags and carpetbaggers are waging war against Southern culture and heritage. More and more communities are outlawing flying and otherwise displaying Confederate flags. “Dixie” is forbidden. “Old Virginia” has been rewritten, and a move is underway to rewrite “Maryland, My Maryland.” Songs of the old South or that glorify the South are ostracized. Confederate monuments are vandalized, and the culprits go unpunished. Many locales are trying to remove their Confederate monuments. Throughout the South, the toadies of the North are trying to destroy all symbols of the Confederacy and the Old South.

    Not only do these miscreants seek to destroy Southern heritage, they seek to destroy the Southern people. Their program is genocide — annihilation of the Southern White by amalgamation into a mongrel race. Their weapon is integration. The Negro is the cannon fodder that is being fired at the Southerner to eradicate him. All that is Southern must perish including, and especially, the Southern people.

    The Southern dialect is under assault. Schools are instructing Southerners how to speak without a Southern accent. Major movie companies come to the South looking for actors and actresses. However, they do not want people who speak like Southerners unless the person is going to play a Southern character who is a scoundrel, reprobate, bully, dolt, oaf, buffoon, etc. To destroy the Southern dialect is to destroy one of the uniqueness of the South.

    These nefarious kowtowers of Yankeedom are also out to destroy the religion of the South, Christianity. Ministers are arrested for handing out tracks. People are arrested for praying silently on federal property. Judges are forbidden to open court with a prayer. Children are forbidden to read the Bible on school buses. Civic organizations that open meetings with prayer are denied the use of public facilities. Teachers are reprimanded for giving Bibles to students. Student speeches are censored to prevent them from telling others about the importance of Christ in their lives. And the oppression goes on and on.

    The list of atrocities inflicted upon the South could go on and could be filled with numerous examples. However, examples of Yankee despotism in the South are so ubiquitous and obvious that there is little need to fill pages with them. The quisling, scalawag, and carpetbagger have taken over the South — and the apathetic Southerners have let them. They have destroyed the independence of the Southern States. They are well on their way to destroying Southern heritage and culture, the Southern people, and the Southern religion. The time has come for Southerners to take back their governments, their heritage and culture, their race, and their religion. The time has come for a free and independent confederation of free and independent Southern States.
